Long, <br />Coal Progr pervisor <br />Director <br />OF ~~[p <br />~ :4 <br />Nc'~ :~ <br />rB'!6 ~ <br />Roy Romer <br />Governor <br />M ¢hae~ 8 Long <br />D rvi sion Director <br />RE: Pattern of Violations and Issuance of Show Cause Order, <br />Basin Resources, Inc., The Golden Eagle Mine, <br />Permit No. C-81-013 <br />I have reviewed your memorandum to me dated October 26, 1993, <br />regarding the Pattern of Violations at the Golden Eagle Mine in <br />Las Animas County. <br />I concur with the staff determination that a Pattern of <br />Violations has existed at the mine. <br />I concur that the ten Notices of Violation and one Imminent Harm <br />Cessation Order do not represent isolated departures from lawful <br />conduct, but rather a broad, overall lack of concern with <br />regulatory compliance by the permittee. <br />I concur that these violations were caused by the unwarranted <br />failure of the permittee to comply with the requirements of the <br />Act, Rules, and permit conditions. <br />I therefore direct you to issue to Basin Resources, Inc., an <br />Order to Show Cause why the Golden Eagle Mine permit should not <br />be suspended or revoked. I find that no exceptional circum- <br />stances exist that would provide a basis for deeming the issuance <br />of such an order as demonstrably unjust. <br />m:\oss\scm\mlong.mmo <br />
