Long <br />Division Director <br />During the Division's inspection of the Bourg Strip Mine on December 17, 1992, two <br />concerns were noted. <br />1. The wording of the insurance certificate will require revision. The current <br />certificate states that the insurance company will "endeavor" to notify the Division of <br />cancellation. Per Rule 2.03.9(3) this statement must be changed to read that the <br />insurance company "will" notify the Division upon failure to renew, cancellation of, <br />or if substantive changes are made to the policy. <br />2.03.9 Personal Injury and Property Damage Insurance Information. <br />(3) The policy shall include a rider requiring that the insurer notify <br />the Division whenever substantive changes are made in the policy, <br />including any termination or failure to renew. <br />2. On page I-5 of the permit application, Walden Coal commits to submitting <br />results of the rill and gully survey to the Division no later than September 1, of each <br />year. For the last two years the Division has been accepting the results of the rill <br />and gully survey with the annual hydrologic and reclamation reports after this date. <br />This has not been a problem with the Division. However, the Division requests that <br />Walden Coal amend page I-5 and commit to a date that all three reports can be <br />submitted together. This page should state that the results of the rill and gully <br />surveys will be submitted with the annual reclamation report and if excessive rifling <br />
