<br />Dear Mr. xhmetc:
<br />On June 3, 1994, the Division received a letter from Mr. Ed xay,
<br />Deputy Director of the Washington, D.C. branch of the Of Lice of
<br />Surface Mining. Mr. Stay's letter was wri[ten in response [o the
<br />Division's February 14; 1994 request for a review by the Deputy
<br />Director of the Division's December 20, 1993 response to AFo
<br />regarding Ten-Day Notice No. ]f-93-020-370-005 7v 3.
<br />In his .letter; Mr. Kay granteB the Division until July 25, 1994 an
<br />opportunity to complete its investigation regazi3ing this Ten-Day
<br />Notice. On July 11, 1994, personnel from the Division revisited
<br />the windmill well and property owned,by Mr_ Jim Tatum of ]louston,
<br />Texas. According to Mr. Tatum in his letter of November 30,. 1993
<br />to AFO, his well was "pow quite dry• due to mining operations
<br />conducted by Basin Resources, Inc.. at their Golden Eagle Mine in
<br />Las Animas County, Colorado. It was this letter that formed the
<br />basis for AFO iasuiaa this Ten-Day Notice_
<br />During the Divisions inspection of Juiy 11, 1994, Division
<br />personnel were accompanied by. Mr. Tatum. At the time of the
<br />inspection, the Division.was able to demonstrate to Mr. Tatum that
<br />water is fact e7dsted.in his well. Oa July 12, 1994, Mr_ Tatum
<br />wrote.a letter to the Division stating that, •it appears that the
<br />well that we thought was dry does have. 40-plus feet of water in the
<br />borehole.._It would appear at this point Lhat the airshaft has not
<br />harmed the well, unless the flow of water into the well bore has
<br />been decreased to the point the well will not produce a usable
<br />quantity of water• (copy of letter enclosed).
<br />In light of Mr. Tatum's recent letter, the Division believes the
<br />issue raised by Mr_ Tatum in his November 1993 letter co R['O
<br />regarding a lack of water in his well has been resolved. As this
<br />concern was the final item remaining to completely address this
<br />
