<br />Colorado Mined Land Reclamation Division <br />Fred R, Banta, Director <br />Findings of the Colorado Mined Land Reclamation Division <br />for Transfer of Permit Rights for Blue Flame Mine <br />(Permit C-81-053) <br />March, 1991 <br />Pursuant to Rule 2.08.6(4) of the Regulations of the Colorado Mined Land <br />Reclamation Board for Coal Mining (Rules) promulgated pursuant to the Colorado <br />Surface Coal Mining Reclamation Act (Act) 34-33-101 et. seq. C.R.S. 1973 as <br />amended, the Division makes the following three written f-'n~ings prior to the <br />approval of the transfer of rights under the permit for the Blue Flame Mine <br />(Permit C-81-053): <br />1. The Division finds the person seeking approval, L & L Energy, Inc „ is <br />eligible to receive a permit in accordance with Rule 2.07.6(1)(b), (c ), <br />and (2); <br />2. The Division finds the applicant, L & L Energy, Inc., has submitted a <br />performance bond at least equivalent to the bond of the original <br />permi ttee; and <br />3. The Division finds the applicant, L & L Energy, Inc., will conduct the <br />operations involved in full compliance with the terms and conditions of <br />the original permit and in accordance with the requirements of the Act <br />and these rules. <br />
