(a) Six dollars per load of 12 tons or less. (b) Nine dollars per load in excess of 12 tons. Payment of the above shall be monthly, one half payable to the County and one half payable to Owner. Coal Company will keep an accurate record of all waste hauled to the dump site. County and Owner may examine Coal Company's records at reasonable times. 3. Coal Company agrees to comply with all terms required of lessee in the attached lease dated January 31, 1977, and to do all things therein required of lessee, though not those things which lessee is merely authorized to do. In addition, Coal Company agrees to construct a gate to the coal waste dump site and to cause said gate to be locked. A key to the gate will be given to County and to Owner, but to no other persons except with permission of both County and Owner. 4. Coal Company may negotiate with other Coal Companies for use of the coal waste dump site; PROVIDED HOFTEVER, that no other Coal Company may use the site without prior approval in writing from County and Owner. 5. Coal Company agrees to be responsible for compliance~it2j-all laws and regulations pertaining to use of the site as a coal waste dump site. Coal Company further agrees to be responsible for all injury to person or property occuring on or because of the coal waste dump site and hereby indemnifies and holds the County and Owner harmless from all liability and any other cost to the County or Owner, including attorney fees, that may arise directly or in- directly as a result of usage of coal waste dump site. 6. The term of this agreement shall be for one year provided however, that at the end thereof the parties may by mutual agreement extend the term for an additional year or years. 7.
