Bog 535 <br />Somerset, CO 81434 <br />(303)929-5775 <br />July 14, 1989 <br />Ms. Susan Mowry <br />MINED LAND RECLAMATION DIVISION <br />COLORADO DEPARTMENT OF NATURAL RESOURCES <br />215 Centennial Building <br />1313 Sherman Street <br />Denver, CO 80203-2273 <br />Dear Ms. Mowry: <br />~~~~ ~~~ <br />JUL t ~ 1989 <br />RECD SAT p~ ~~v~S~OfV <br />Yesterday, the U.S. Bankruptcy Court in Denver approved a lease <br />agreement between Kaiser Coal Corporation and Somerset Mining <br />Company (SMC) which calls for the leasing by SMC of the entire <br />Somerset Mine property now owned by Kaiser Coal Corporation. <br />At the present time it is the intent of SMC to operate all of the <br />Elk Creek facilities at the Somerset Mine for purposes of loading <br />coal trains with coal produced from other mines within the area. <br />We therefore respectfully request that the Elk Creek surface <br />facilities located on the Somerset Mine property be withdrawn <br />from their present status of being in temporary cessation and <br />placed into active status. <br />For the time being, SMC will become the operator of the property <br />and USS Mining Company will remain as the permittee and will <br />maintain the reclamation performance bond on the property. <br />'Fhe responsible individual for you to contact on matters concern- <br />ing the property will be SMC employee, William Pecharich.
