A number of issues resardin tt final reclamatien were <br />addressed in the mid-term lever, and aporoprate revtston of the permit was requested. The loner requued that a <br />technical revision application addressing the identified concerns be submined by October 8. ?000. Powdernorn <br />submtned a technical revision aopltution (TR•~u) addressing a portion of one identified concern (?-west Porals and <br />South Fan reclamation sediment control) in early September'_000. and this revision application w; s approved by <br />DtvIG. Powderham has failed to submit a revision application addressins the remaining nine compliance issues <br />identifieC by the Division. Items to be addressed include: (I) documenwtion of final resolution or current status of <br />cerain State of V irginia and West Virginia violations: (-) sediment control plan for final reclamation of [hc Norh <br />Portal Coal Handling Area; (~) evaluation of the effect of seepage in the vicinity of the South Porals on final backtill <br />stability in that area: (a) evaluation of the need for provision of drrinage pipes through the recently insta}led South <br />Poral seals: (5) provision of modified surface drainage plan for reclaimed South Portal facilities area and Roatside <br />Refuse Disposal Area (RSRDA); (6) identification of an alternative soil bortow azea for non-toxic refuse cove- for <br />RSRDA; (7) evaluation of «vegetation success standards and possible need for remedial revegetation aeatments in <br />cerain previously revegetated areas; (8) update tact and maps to reflect Ute Water Conservancy District's new six <br />foot diameter steel Plateau Creek mw wa[er pipe; and. (9) update subsidence protection "Manmade Features Map- if <br />warranted. Because mining ceased ac Roadside on December <br />2, 1999, "Year I" of the approved reclamation schedule is to be iniriated no later than December 2. ?000.
