20. Powderhorn and Frontier would have certain <br />administrative appeal rights from such a Notice of violation. <br />21. If the Division of Minerals and Geology or the <br />Mined Land Reclamation Board upholds the Notice of Violation, <br />after Powderhorn's or Frontier's exhaustion of such <br />administrative appeals, then the State of Colorado would <br />forfeit the Frontier Bond. <br />22. The State of Colorado has not determined whether the <br />amount of the two reclamation Bonds is sufficient to pay for <br />all of the reclamation work which Powderhorn is required to <br />perform, assuming that Frontier and Utica are able to pay, and <br />do pay, the full face amount of the Bonds. <br />23. Based upon the information presently available to <br />the State of Colorado, there is substantial uncertainty <br />whether Frontier will be able to pay the Frontier Bond in full <br />12 <br />
