Therefore, pursuant to its Permit, Powderhorn must <br />start to reclaim the site at some time between December 3, <br />2000 and March 15, 2001. <br />10. But for the circumstances described below, <br />Powderhorn would have a period of time within which to perform <br />its on the ground reclamation obligations. However, within a <br />total period of 3 years at the most, Powderhorn would have to <br />complete all of the physical work. Powderhorn's Permit <br />requires it to accomplish certain reclamation tasks in each of <br />the three years. See Reclamation Time Table attached to Jim <br />Stover's March 13, 2000 letter (Exhibit E). <br />11. If Powderhorn fails to complete reclamation work <br />according to this schedule, it will be in default under the <br />Permit, and the Division of Minerals and Geology will issue a <br />Notice of Violation. <br />12. Powderhorn would have certain administrative appeal <br />rights from such a Notice of Violation. <br />13. If the Division of Minerals and Geology or the <br />Colorado Mined Land Reclamation Board upholds the Notice of <br />Violation, after Powderhorn's exhaustion of such <br />9 <br />
