<br />heard by the Honorable Judith A. Boulden, United States <br />Bankruptcy Judge, on June 6. 1994, at the hour of 10:30 a.m., or <br />as soon thereafter as counsel may be heard, in Judge Boulden's <br />Courtroom located on the third floor of the Federal Courthouse <br />Building located at 350 South Main Street, Salt Lake City, Utah. <br />The Motion requests approval of a settlement of the above- <br />captioned adversary proceeding between the parties. CF&I brought <br />this action against Holland alleging that certain transfers made <br />to it constitute avoidable preferences under 11 U.S.C. § 547(b). <br />The parties have agreed to settle the matter with Holland making <br />a payment of $82,500.00 to the Debtors' estates. Copies of the <br />Motion and the related Settlement Agreement may be obtained by <br />request from the undersigned counsel for CF&I. <br />PLEASE TAKE FURTHER NOTICE that, pursuant to Rule 523 (b) <br />of the Rules of Practice of the United States Bankruptcy Court <br />for the District of Utah, objections to the Motion must be <br />submitted in writing, filed with the Bankruptcy Court, and served <br />upon the undersigned Counsel on or before Tuesday. Mav 31. 1994. <br />Absent timely filing and service of objections, the hearing may <br />be stricken and the relief sought in the Motion may be granted by <br />the Court without further notice or hearing.
