Luc hhead
Executive Direc~ar
Michael B. Long
Drviaion Dneaor
(landowner above MCC
I received a phone call today from Elaine Mautz who is a landowner
above the West Elk Mine, operated by Mountain Coal Company. She
told me that the road in Lone Pine Gulch has been made impassable
by MCC's mining. She said that about 200-300 yards past the fan is
where the road begins to deteriorate. She said that the road is
sliding. She said there are no cracks on the road. She said that
she understands that it is a wetter year, but they experienced some
subsidence and problems last year when it was drier. She also MCC
has a dozer stuck in the road. She said that MCC is refusing to
repair the road because they say it is not due to their mining but
to the increase in precipitation. She did say that at one point
MCC had agreed to repair the road and did start but did not finish.
She said they (Mautz's) are willing to repair it, but would charge
MCC because they are working on other projects and would be
inconvenienced. She wants them to at least fix the road so its
passable. She mentioned installing culverts, ditches, etc.
In addition, she said that the cabin in Lone Pine has received some
damage. There are cracks in the walls and/or foundation due to one
side settling more than the other. She said MCC has agreed to fix
the cabin by September 17, 1995. Mrs. Mautz said she had told them
September 6, 1995. She said that MCC is supposed to be getting
bids today to repair the cabin.
I told her that I would be there next week and would call her
Monday if she was interested in going up there with me. She said
she would be.
CEJ/007.825
