August 3, 1977. The county special use permit on pages 13.01 and 13.02 of the permit application
gave county approval for mining operations along the county right-of--way.
The Division granted approval, pursuant to Rule 2.07.6(2)(d)(v), for mining operations within
300 feet of an occupied building. The occupant of the trailer that was owned by the mining
company signed a legal waiver.
The Division granted approval, pursuant to Rule 4.05.18, for mining operations within 100 feet of
Trout Creek, a perennial stream.
The operator, through TR-02, has committed to the hydrologic monitoring program described on
page 65.06 of the permit application. The program includes triennial sampling of field parameters
only. Resumption of mining would require revision of this plan.
Through MR-04, the Division waived the requirement of Rule 4.05.13(4)(c) for submittal of an
Annual Hydrology Report, substituting, instead, the triennial reports. Resumption of mining could
require revision of this waiver.
SECTION VI -BONDING SUMMARY
The Division holds an approved bond on behalf of the Sunland Mining Corporation for the Apex
No. 2 Mine. The bond is a surety-type bond with riders, number 64S100507892BCA, for
$172,020.00, issued by the Aetna Casualty and Surety Company. Pursuant to Rule 3.02.2(4), the
Division has initiated a review of the Apex No. 2 bond liability. The pending Phase I Bond
Release application will influence this process.
~nrnc.hrr
