The county special use permit on pages 13.01 and 13.02 of the permit application <br />gave county approval for mining operations along the county right-of--way. <br />The Division granted approval, pursuant to Rule 2.07.6(2)(d)(v), for mining operations within <br />300 feet of an occupied building. The occupant of the trailer that was owned by the mining <br />company signed a legal waiver. <br />The Division granted approval, pursuant to Rule 4.05.18, for mining operations within 100 feet of <br />Trout Creek, a perennial stream. <br />The operator, through TR-02, has committed to the hydrologic monitoring program described on <br />page 65.06 of the permit application. The program includes triennial sampling of field parameters <br />only. Resumption of mining would require revision of this plan. <br />Through MR-04, the Division waived the requirement of Rule 4.05.13(4)(c) for submittal of an <br />Annual Hydrology Report, substituting, instead, the triennial reports. Resumption of mining could <br />require revision of this waiver. <br />SECTION VI -BONDING SUMMARY <br />The Division holds an approved bond on behalf of the Sunland Mining Corporation for the Apex <br />No. 2 Mine. The bond is a surety-type bond with riders, number 64S100507892BCA, for <br />$172,020.00, issued by the Aetna Casualty and Surety Company. Pursuant to Rule 3.02.2(4), the <br />Division has initiated a review of the Apex No. 2 bond liability.
