.t-.., <br />~ Sec. I5. SPECIAL S7IPULA71ONS ICont'd.l - <br />This lease is subject to valid rights existing on the date of [ease issuance. <br />(a) Cultural Resources. (1) If cultural resources are discovered during operations <br />under this lease, lessee shall immediately notify the authorized officer of the Bureau of Land <br />Management (BLM) or the Office of Surface Mining Reclamation and Enforcement <br />(OSMRE). Lessee shall not disturb such discovered resources except as subsequently <br />authorized. Within 5 working days of notification, the authorized officer shall examine, or <br />have examined, any cultural resources discovered and will determine if any action may be <br />required to protec[ or preserve such discoveries. Cost of data recovery or mitigation for <br />cultural resources discovered during lease operations shall be borne by lessee. <br />(2) Lessee shall submit a mitigation plan for review and approval to the <br />authorized officer if surface disturbance is proposed at archaeological site SRT32. <br />(3) Prior to any mining activity at archeological site SRT345, work shall be <br />conducted to mitigate possible adverse effects of subsidence to 9nclude, (1) mapping, <br />drawing, photography, and dating of rock art, and (2) rockshelter excavation. Lessee shall <br />submit a mitigation plan for review and approval to the authorized officer. Lessee shall <br />document consultations with Ute and Shoshone tribal councils regarding the effects of <br />proposed mining on SRT345 and any religious concerns of the tribes. <br />(b) Paleontological Resources. (1) Lessee shall immediately cease all operations <br />upon discovery of fossil(s) of scientific value, and shall notify the authorized officer. Within <br />two working days of notification, the authorized officer shall evaluate and/or remove such <br />discoveries. Additional time may be negotiated if mutually agreed upon by the lessee and the <br />authorized officer of the BLM. <br />(2) The cost of any required paleontological surveys and recovery of any <br />fossil(s) of scientific value discovered during lease operations shall be borne by the lessee. <br />(c) Water. Alluvial Valley Floor. Lessee shall not conduct surface operations or <br />cause any surface impacts within the boundaries of the Fish Creek alluvial valley floor or <br />floodplain in sec. 36.
