Proposed Decision <br />The Division proposes to approve a renewal (Permit Renewal Number 3) of a valid, existing <br />permit (C-81-019) to conduct mining (surface mining and reclamation activities) in Colorado. <br />The Application was submitted by Colowyo for the Mine. This decision is based on a finding <br />that the operations will comply with all requirements of the Colorado State Program as found in <br />the Colorado Surface Coal Mining Reclamation Act, C.R.S. 34-33-101 et seq., and the <br />Regulations promulgated pursuant to the Act. If no request for a formal hearing is made within <br />thirty (30) days of the first publication of the issuance of this proposed decision, then this <br />decision becomes final. Acceptable surety by the applicant is on file with the Colorado Division <br />of Minerals and Geology. The Application and all supporting documentation and any <br />stipulations or conditions will become a binding part of the permit. <br />No coal mining operations may be conducted on any Federal surface or coal until the Secretary of <br />the Interior has approved the proposed mining plan. <br />3. Summary <br />3.1 History of the Review Process <br />3.1.1 Initiation and Progression of the Renewal <br />By letter of February 5, 1997, the Division notified Colowyo of the need to renew permit (C-81- <br />019) for the Mine. By letter of Apri19, 1997, Colowyo responded by submittal of an <br />Application Form, Renewal of a Valid, Existing Permit to Conduct Mining in Colorado, with <br />supporting information. Colowyo notified the public of intent to renew the Permit (see paza 3.1.2 <br />following). By letter of April ]4, 1997, the Division notified Colowyo that their Application was <br />complete for the purposes of filing as of April 18, 1997. The Division notified the public of the <br />Application (see paza 3.1.2 following). The Division requested additional information from <br />Colowyo by letters of June 23, 1997, and July 15, 1997.
