BOX 204$ Executive Director <br />Granb ,Colorado 80446 Ronald w. cottony <br />y Division Director <br />/ Natural Resource Trustee <br />RE: Overlook Mine, Permit No. M-2006-075, Complaint Regarding Possible Illegal Mining Activity <br />Dear Mr. Pratt: <br />On July 17, 2007, the Division of Reclamation, Mining and Safety (DBMS) received your correspondence <br />including letters dated July 12 and 16, 2007 requesting that possible illegal mining activity conducted by <br />Granby Ranch be investigated. These letters indicated that on July 10 and 15, 2007 you and your employee <br />David Lorenz observed trucks hauling gravel from the Granby Ranch or Silver Creek vicinity to locations off <br />the Granby Ranch Property. <br />Thank you for your concern regazding potential illegal mining in Colorado. Upon review of DBMS files, it was <br />determined that on June 28, 2007, Granby Realty Holdings, LLC. was issued a Regular 112c permit for the <br />Overlook Mine (old Linke Const. Co. Gravel site). As of that date material from the Overlook Mine maybe <br />hauled to locations beyond the Granby Ranch property and is no longer restricted to Granby Ranch property as <br />initially required by a declaratory order issued to Silver Creek Resort in 1997. DBMS assumes this is the same <br />pit referred to as the "Silver Creek Pit" in your letters. Please notify DBMS if this assumption is incorrect. <br />Your letter also included a signed, notarized affidavit from Mr. David Lorenz indicating that on May 22, 2007 <br />he observed a truck loaded with gravel pull out of the Granby Ranch area, haul and dump the material at a <br />church in Tabernash, Colorado, where several other piles of gravel were noted. <br />Regardless that this date is prior to issuance of the Overlook Mine permit, there is no direct evidence that the <br />truckload of gravel or the other piles of gravel came from the location now permitted as the Overlook Mine, or <br />from any other non-permitted site.
