The Division issued a construction permit, number <br />O1LA0642, for Lorencito Coal Company to conduct surface mining activities to include material <br />extraction, handling, hauling and stockpiling of materials. In response to complaints received by the <br />Division, the Field Enforcement Officer (FEO) Mr. Paul Carr conducted several site inspections at the <br />Lorecito facility to determine compliance with the terms of Lorencito's construction permit number <br />O1LA0642. Lorencito facility inspections were conducted by the FEO on the following dates: <br />November 9, 2001 <br />November 21, 2001 <br />OF ~~C <br />R~ o,P <br />.k~ 6Q~ <br />Colorado Department <br />of Public Health <br />and Environment <br />January 10, 2002 <br />November 30, 2001 <br />December 15, 2001 <br />January 7, 2002 <br />January 9, 2002 <br />Lorencito routinely schedules blasting activities for late in the day, however, complaints received <br />indicated that Lorencito is conducting blasting activities after sunset. The FEO informed Lorencito <br />employees, Mr. Daniel Risner on Nov. 21, 2001 and Mr. Elmer Bentley and Mr. Bruce Addington on <br />Nov. 30, 2001, that blasting activities would need [o occur before sunset in order to have enough ambient <br />light available to detemune compliance with the permit terms for fugitive dust emissions. A review of the <br />blasting logs provided by Buckley Powder Company indicates that Lorencito conducted blasting after <br />sunset at least seventeen times in the last two months, based on sunset information available for Trinidad <br />
