On December 8, 1994, the Division received an application for a transfer of permit and <br />succession of operator. With the approval on January 24, 1995, permit C-81-038 was transferred <br />from Cyptvs Orchard Valley Coal Corporation to Bowie Resources Limited. <br />The operator for the Bowie No. 1 Mine was changed in Minor Revision No. 99, from Bruin <br />Mining Company to Sherpa Paonia, Inc. MR-99 was approved with conditions on January 21, <br />1997. Stipulation no. 52 was attached to MR-99 and approved the transfer conditional upon the <br />continued compliance with a settlement agreement that had been linked to the operator. With <br />Technical Revision No. 28, the operator has been changed from Sherpa Paonia to Bowie <br />Resources Limited. <br />This proposed decision and findings document is for permit renewal number 3 (RN-03). The <br />Division sent the required notice to the applicant that a complete permit renewal needed to be <br />submitted by October 20, 1997. Bowie Resources Limited submitted the renewal package on <br />October 20, 1997. The renewal package was called complete on the same day. Thirty days after <br />completeness, the Division sent out its first adequacy review letter, dated Decetber 16, 1997. <br />BRL responded to this initial adequacy review letter with a submittal dated February 20, 1998. <br />The Division=s second adequacy review letter was sent on April 2, 1998. BRL=s response on <br />Apri127, 1998 provided the backfilling and grading reclamation plan that was agreeable to both <br />parties. Tn a letter dated June 22, 1999, the Division sent to BRL the Division's revised <br />reclamation cost estimate. After further correspondence involving details of the reclamation cost <br />estimate, BRL agreed to the cost estimation. <br />This document contains the "Proposed Decision to Approve With Stipulations the Permit <br />Application", a description of the environment affected by the mining operation and the <br />reclamation plan, and the Division's written findings of compliance as required by the Colorado <br />Surface Coal Mining Reclamation Act. Detailed information concerning the review process is on <br />file at the Division offices; legal requirements can be found in the Act and Regulations of the <br />Colorado Mined Land Reclamation Boazd for Coal Mining. All rules referenced in [his <br />document aze contained within the Regulations. Detailed information about the proposed mining <br />and reclamation operation can be found in the permit application on file (File No. C-81-038) in <br />the public record maintained by the Division, located in Room 215, Centennial Building, 1313 <br />Sherman Street, Denver, Colorado 80203, telephone (303) 866-3567. Copies of the application <br />aze also available for inspection at the Delta County Clerk and Recorder's Office in Delta, <br />Colorado. <br />Right of Successive Renewal <br />C.R.S 34-33-109(7) and Regulation 2.08.5 allow arr operator [o permit any lands outside the <br />five-year mine plan azea with the right of successive permit renewal. Bowie Resources Limited <br />has exercised this right by submitting a complete permit renewal application package at ]east 180 <br />days before the current permit expires. The permit area for the Bowie No. I Mine that was <br />included in the application contains coal reserves projected to last to the yeaz 2010. The Division <br />originally granted CWI approval to mine all of these lands (subject to the attached conditions). <br />However, the permit term will be divided into five-yeaz increments.
