-2- <br />PRUPUSEU UECISIOIV <br />United States Steel Corporation - Somerset line <br />The Colorado Mined Land Reclamation Division proposes to approve, with <br />stipulations, an application fur a permit to conduct coal iaininy <br />operations submitted by United States Steel Corporation for the Somerset <br />Mine. This decision is based on a finding that the proposed operation <br />will comply with the requirements of the Colorado Surface Coal Mining <br />Reclamation Act, C.R.S. 1973, as amended, 34-33-101 et sue., and the <br />Keyulations pro~nugated pursuant to the Act.The finding of compliance, and <br />the stipulations which are a part of this approval, are attached to this <br />document. The pennit cannot be issued until all statutory notice and <br />public comment requirements have been satisfied, and until bond has been <br />posted.The permit application and the stipulations will become a binding <br />part of the pennit upon approval. The stipulations for the Somerset Mine <br />are as follows: <br />Stipulation No. 1 <br />THE SOMERSET MINE RECLAIMED AREAS SHALL ACHIEVE AT LEAST THREE <br />CU UL SEASON PERENNIAL GRASSES ANU ONE PEREIVNIHL FURB WITH <br />RELATIVE COVER EQUAL TU UR GREATER THHIV THREE PERCENT. THE <br />Cuh1BINEU RELATIVE COVER SHOULD NUT EXCEED 80 PERCENT AWU IVU <br />OWE SPECIES SHOULD CUf4PRISE GREATEK THAN b0 PERCENT . <br />Stipulation No. 2 <br />THE OPERATOR SHALL hIENSURE WOODY PLHNT DENSITY AND VEGETATi01V <br />COVER THE FIRST AND THIRD GROWING SEHSONS AT IIVTENSiTIES EQUAL <br />TU BASELINE SAMPLING LEVELS. <br />Stipulation No. 3 / <br />THE OPERATOR SHALL DELETt RUBBER RABBITBRUSH FROM THE PROPOSED <br />RECLAMATION SEED MiX. <br />Stipulation No. 4 / <br />WITHIN 120 DAYS OF PERIvIIT ISSUANCE U.S. STEtL SHALL SUBhIIT A <br />SuBSIUENCE f40NITORING MAP WHICH COMMITS TO THE INSTALLATION OF A <br />CENTERLINE SUBSIDENCE MONITORING MUWU14EiVT ABOVE EHCH ENTRY OF <br />THE 5th WEST MAINS. <br />
