-~- <br />In lieu of a public liability insurance policy certificate as required by <br />Rule 2.03.9(1) U.S. Steel has provided evidence of its financial <br />capability fur self-insurance in the form of financial reports from 1979 <br />and the third quarter of 19dU as Nppendix U in the permit application. <br />Contacts with the Colorado Mate Insurance Division reveals that at <br />present there are no State requirements for self insurance. The financial <br />capability demonstrated by United States Steel Corporation is far in <br />excess of the required insurance coverage of Rule 2.03.9(1). (IIV 1979 <br />U.S. Steel nad assets in excess of $11 pillion, and net worth of almost <br />$5 billion - more than most insurance companies) The Division therefore <br />accepts the self-insurance request for operations at the Somerset Mine as <br />allowed by Rule 2.03.9(4). <br />Tne application is in compliance with the requirements of this section. <br />Ii. Land Use - mules 2.04.3, 2.05.5 and 4.16 <br />Tne existing land use of the ina,7Drity of the permit area is as <br />undeveloped land. Disturbed surfaces witnin the permit area are <br />industrially used far the purpose of coal production. The undeveloped <br />lands within the permit area provide a small amount of livestock yrazing <br />(primarily sheep), fish and wildlife haoitat and recreational <br />opportunities. <br />The discussion of existiny land uses occurs un paye Z.U4-2 throuyh <br />2.04-10 of the permit application. existing land uses are shown on i~1ap <br />Ed-32ts4 Volwne Ii of the permit application. The post-mininy land use is <br />described on page 2.05-49 of the permit application and shown on Map <br />E8-33u0 Volume II of the permit application. <br />The return of all affected lands to undeveloped land use satisfies the <br />requirements of mule 4.1b. Pursuant to Rule 2.07.6(2), the Division <br />approves the post-mining land use. <br />Tne application is in compliance with the requirements of this section. <br />III. Bureau of Cana 14anagement is contained on pages <br />2.04-11 throuyh 2.04-14 of the pe nnit application. <br />Two resources with the potential for inclusion in the National Register <br />of Historic Places were identified by these searches. They are: the <br />Donrinyuez Esc al ante expedition and the Somerset Cemetery. No specific <br />sites were identified with the Dominguez Escalante Expedition but <br />artifacts of the expedition nave been found in the Hubbard Creek drainage. <br />
