Alternative design criteria and specifications have been approved for use in sediment pond <br />design and/or construction. This decision is based on a thorough analytical demonstration by a <br />qualified professional engineer that the resulting sediment pond will be environmentally sound <br />and structurally stable, taking into consideration physical, climatological, and other <br />characteristics of the site (4,05.6(11)). <br />Acid-Forming and Toxic-Formin¢ Spoil - <br />No acid-forming or toxic-forming materials have been identified at the Bowie No. l Mine. <br />Impoundments - <br />All site impoundments are in compliance with Rule 4.05.9. Refer to Section 1[I, C, above. <br />Surface and Ground Water Monitorine - <br />The applicant will conduct monitoring of ground water in a manner approved by the Division. <br />The ground water monitoring plan is found in the approved permit application, Volume 1 A, <br />Section 2.05.6, and Volume 8. <br />The applicant will conduct monitoring of surface water in a manner approved by the Division. <br />The monitoring plan is found in the approved permit application, Volume 1 A, Section 2.05.6, <br />and Volumes 8 and 8A. <br />Transfer of Wells - <br />Transfer of wells is not proposed during this five-year permit term. <br />Discharge of Water into an Underground Mine - <br />Discharge of water into underground workings will not occur. <br />Stream Buffer Zones - <br />No disturbance is anticipated within 100 feet of a stream with a biological community. <br />Probable Hvdrologic Consequences - <br />Ground Water - <br />The Bowie No. 1 Mine has the potential to affect ground waters in three ways -degradation <br />of water quality, mine consumption of water, and dewatering of insignificant bedrock <br />aquifers. Each of these cases will be discussed in detail in the following pazagraphs. <br />Degradation of ground water quality could occur in three locations. The train loadout and <br />auxiliary coal stockpile aze located on an alluvial terrace of the North Fork of the Gunnison. <br />Runoff infiltration could result in the dissolution of salts. The operator installed and <br />monitors three wells downgradient from these facilities and has not detected any significant <br />water quality changes. The Division has expressed some concern about the narrow band of <br />alluvium found downdip of the underground waste development stockpile. The operator <br />has installed a well (Node 22) and is monitoring that location for impacts. No impacts have <br />26 <br />
