Doughty, hereinalter referred t:o as <br />"Sellers" and Lakewood Brick and Tile Company, ltereirtafter referred to <br />as "Buyer", is made to Lhe agreement dated August 1, 1971, between <br />Leland Doughty and Buyer; <br />In consideration of the mutual covenants and promse.es con- <br />tained herein and In [he original Agreement, the parties agree ens <br />follows: <br />1. The terms of this addendum shall supercede inconsistent <br />terms of the August 1, 1911 Agreement. <br />2. Beatrice K. lluughty is hereby agreeing to the terms of <br />this Addendum and clre August 1, 1971 Agreement. <br />3. 'Ciro legal descriptions of real property as set forth in <br />the first '~WiiGltL'AS" clause, and paragraph 14 titled "Option" of the <br />August 1, 1911 Agreement arc changed to the Co.llowing: <br />See attached Exhibit A for legal description. <br />4. Should seller present a contract [o buyer pursuant to <br />buyer's option anJ right of first refusal, which contract provides fur <br />closing more than six months after buyer's failure to exercise i.[s right <br />and option, due to contingencies in the contract, then seller shall have <br />Che right to consumate the contract at any tlmo pri.ur [u the expiration <br />date o1 the contract, notwithstanding [hat the expiration data of Lhe <br />contract is more than six months after buyer's f.allure to exerciau its <br />[fight and option. The expiration date of the contract shall be the same <br />date as the date set for closing.
