Long <br />Oak Creek, CO 80467 oivisiun oirecinr <br />RE: Insurance Documentation for Permits C-82-0~6, C-81-071, C-84-062 <br />Dear Mr. Mills: <br />The Division is in receipt of the verification of insurance for the Foidel Creek Mine, <br />Eckman Pazk, Mine 1 and 2 Mines, and Energy Mine No. 3, under new ownership, RAG <br />American Coal Holding ,Inc. The documentation is compliance with Rules 2.03.9(1) <br />and (2). Rule 2.03.9(3) requires that, "The policy shall include a rider requiring the <br />insurer notify the Division whenever substantive changes are made to the policy." The <br />certificate received by the Division includes the wording, "...the company will endeavor <br />to mai160 days written notice to the above named certificate holder, but failure to mail <br />such notice shall impose no obligation or liability of any kind upon the company or this <br />agency." Please remove the wording, "endeavor to" and "but failure to mail such notice <br />shall impose no obligation or liability of any kind upon the company or this agency.", <br />from the certificate.
