<br />EXHIBIT "A" <br /> <br />AMENDMENT #1 TO LAKEWOOD-ROBCO AGREEMENT <br />~S AMENDMENT is made and entered <br />of 1984, by and between the City <br />a municipal corporation of the State of <br />referred to as "Lakewood", and Robinson <br />Colorado corporation, Denver, Colorado, <br />to as "Robco." <br />W I T N E S S E T H <br />into this ~ day <br />of Lakewood, Colorado, <br />Colorado, hereinafter <br />Brick Company, a <br />hereinafter referred <br />THA•3', WHEREAS, .Lakewood and Robco have entered into an <br />agz~eemen•~ dated July 28, 1983 hereinafter referred to as <br />"Agreement", affecting certain lands and mineral interests <br />in Sections 24, 25, and 26, Township 4 South, Range 70 West <br />of the Sixth P.M., City of Lakewood, County of Jefferson, <br />State of Colorado, lying south of West Alameda Parkway; and <br />WHEREAS, Robco has been issued a 112 Mined Land Re- <br />clamation Permit for that area of the property described in <br />Exhibits "B", "C-1" and "C-2" of the~Agreement, hereinafter <br />referred to as "tdining Area"; and <br />WHEREAS, Lakewood and Robco have recognized certain <br />areas of mutual concern which are not regulated by the Mined <br />Land Reclamation .Board; and <br />WHEREAS, both parties are desirous of amending the <br />Agreement to address these concerns. <br />NOW, THEREFORE, in consideration of the above recitals <br />and the covenants and promises hereinafter set forth, the <br />parties covenant and agree as follows: <br />1. Robco shall provide erosion protection consistent <br />with good engineering standards acceptable to Lakewood for <br />the existing drainageway on the north side of the mining <br />area and south of Alameda Parkway. <br />2. Plant establishment of the plant materials described <br />in the reclamation plan approved by the Mined Land Reclamation <br />Board for reclamation in the Mining Area shall be a minimum <br />of eight (8) plants per square foot. <br />
