15. The Division has contacted the Office of Surface Mining, Reclamation Fees <br />Branch. As of this time, Peabody Coal Company, the operator, is current in <br />the payment of reclamation fees required by 30 CFR Chapter YII, subchapter R <br />(2.07.6(2)(0)). <br />16. Specific approvals have been granted or are proposed. These approvals are <br />addressed in the following section, Section B (2.07.6(2)(m)). <br />SECTION B <br />The following findings and specific approvals are required by Rule 4 <br />I. Roads - Rule 4.03 <br />A. Haul Roads <br />Details of haul road design and construction are located in Volume 10, <br />Table 12 of the permit application. <br />There are approximately seventeen miles of existing haul roads at the <br />Seneca II Mine. These roads are shown on Exhibit 12-1 of the permit <br />application package. Haul roads at the site extend from the mine <br />entrance to the pits, as well as within the pit areas. All haul roads <br />will be reclaimed upon cessation of mining. <br />1. Alternative criteria and specifications were used during the design <br />of haul roads. These criteria and specifications were approved by <br />the Division following an analytical demonstration that the roads <br />would be environmentally sound and reclamation could be achieved. <br />The proposed criteria and specifications pertain to haul road F1, a <br />portion of which is built on a 110' fill embankment, and was <br />constructed prior to August 3, 1977. Details of the road <br />construction and design are located in Volume 11, Tab 12. <br />(4.03.1(1)(e)). <br />2. The Division has approved the temporary alteration or relocation of <br />a natural channel drainageway located on Haul Road F1. The <br />applicant has successfully demonstrated that the natural channel <br />drainage will not be permanently blocked, no significant damage <br />will occur to the hydrological balance, and no adverse impacts will <br />occur to adjoining landowners. The drainageway to be affected is <br />crossed by the 110' F1 Haul Road embankment, which will be removed <br />upon the cessation of mining. The road was constructed prior to <br />August 3, 1977. The following stipulation upon the original permit <br />remains in effect: <br />Stipulation No. 17: <br />THE EMBANKMENT MUST BE INSPECTED ANNUALLY, OR WITHIN 10 DAYS <br />FOLLOWING A STORM WHOSE BACKWATER ELEVATION EXCEEDS THE <br />ELEVATION OF 6941.1 FEET ABOVE SEA LEVEL (10-YR, 24-HOUR <br />MAXIMUM STORM EVENTS PROJECTED BACKWATER ELEVATION), BY A <br />QUALIFIED GEOTECHNICAL ENGINEER OR ENGINEERING GEOLOGIST. A <br />LETTER OF CERTIFICATION CONTAINING THE RESULTS OF THAT <br />INSPECTION MUST BE SUBMITTED TO THE DIVISION WITHIN TWO WEEKS <br />FOLLOWING THE INSPECTION.
