<br />Summary <br />The Rimrock Coal Company, a Colorado Corporation, applied for a permit renewal under <br />the Colorado Surface Coal Mining Reclamation Act (C. R.S. 34-33-101 et sey.) and the <br />right to successive renewal as described under Rule 2.08.5 of the Regulations of the <br />Colorado Mined Land Reclamation Board for Coal Mining. The mine is located <br />approximately three miles southeast of Trinidad, Colorado, on County Road 73.4 near <br />the abandoned town site of Engleville in Section 29, Township 33 South, Range 63 West <br />of the 6th Principal Meridian. The mine site is located on the U.S. Geological Survey 7.5 <br />minute Quadrangle map titled "Trinidad East". <br />The original Rimrock Mine application was submitted to the Division on February 16, <br />1989 and deemed complete on February 26, 1989. On December 12, 1990, the permit <br />was issued but was not effective since the reclamation bond of $53,000.00 had not been <br />supplied to the Division. On November 6, 1992, the Division accepted a letter of credit <br />in the amount of $62,000.00. <br />Mining operations commenced in November 1992. Mining ceased in February 1993. <br />The office and all facilities were removed after mining ceased. Backfilling and regrading <br />of the site occurred in the spring and summer of 1993. Topsoil replacement, seeding <br />and mulching of the majority of the mine site occurred in the summer and fall of 1993. <br />Additional reclamation of two SAE locations and a small portion of the southern end of <br />the mine occurred in November 1994. <br />The Review Process <br />The Division sent Rimrock Coal Company notice on March 22, 2000 of the company's <br />approaching permit expiration date of December 12, 2000. The operator submitted an <br />application for renewal of the permit on June 14, 2000. The application was found <br />complete on July 25, 2000. Proof of publication of the notice regarding submittal of the <br />application was received by the Division on October 5, 2000. No public comment was <br />received as a result of the public notice. Agencies notified of the renewal application <br />included the Office of Surface Mining, Colorado Department of Public Health and the <br />Environment, Las Animas County, and the local Natural Resources Conservation <br />District. No comments were received from any of these agencies. The AVS was queried <br />on September 20, 2000 and returned a "deny" recommendation based on outstanding <br />violations in Oklahoma. <br />In a letter dated December 7, 2000, the Division provided adequacy comments to the <br />operator following review of the permit application. On January 30 and February 5, <br />2001, the Division received responses to our adequacy questions. Correspondence from <br />the State of Oklahoma, Department of Mines indicated that outstanding violations have <br />been resolved through a settlement agreement. On February 12, 2001 a query of the <br />AVS returned an "issue" recommendation. <br />2 <br />
