The Division has made a negative determination for the existence of alluvial valley <br />Floors within the permit area. This determination is based on information provided by <br />the applicant which demonstrates that neither perennial streams nor lands that meet the <br />criteria of Rule 2.06.8 exist in the permit area. A reconnaissance study of the area <br />was performed by Panorama Resources. (2.07.6(2)(k) and 2.06.8(3)(c)) <br />For additional specific findings concerning this alluvial valley Floor please see Section <br />B, XVII. <br />13. The Division hereby approves the post-mining land uses of the operation. It was <br />determined that the post-mining land uses of rangeland and wildlife habitat meet the <br />requirements of Rule 4.16 for the permit area. (2.07.6(2)(1)) <br />14. Specific approvals have been granted or are proposed. These approvals are addressed <br />in the following section, Section B. (2.07.6(2)(m)) <br />15. The Division finds that the activities proposed by the applicant would not affect the <br />continued existence of endangered or threatened species or result in the destruction or <br />adverse modification of their critical habitats. (2.07.6(2)(n)) <br />16. The Division has contacted the Office of Surface Mining, Reclamation Fees Branch. <br />As of this time, the operator, Landmark Reclamation, Inc., is current in [he payment of <br />reclamation fees required by 30 CFR Chapter VII, subchapter R (2.07.6(2)(0)). The <br />mine is reclaimed and no coal will be extracted in the forthcoming permit term. <br />Section B -Rule 4 <br />I. Roads -Rule 4.03 <br />The applicant had previously provided information on drainage control for the road <br />which was used as a haul road in Sections 2.05.3(1), 2.05.3(2) and (3). The operator <br />has previously supplied the Division with a certified design for the haul road and all <br />[he requirements of 4.03.1 have been complied with. As a result of Technical <br />Revision No. 10 (TR-10), approved November 3, 1994, the Division approved <br />reclassification of the haul road to an access road. All of the requirements of Rule <br />4.03.2 have been complied with. TR-10 also approved reclamation of the southern <br />portion of the road. Landowner approval was received at that time. Due to a change <br />in landowners in the spring of 1995, the Division requested verification of the new <br />landowners desire to retain the existing portion of the road.
