<br />AND CONTROL REGULATIONS. ONCE ALL AVENUES OF JUDICIAL <br />REVIEW HAVE BEEN EXHAUSTED, THIS PERMIT WILL BE REVIEWED TO <br />DETERMINE IF I'i' IS IN COMPLIANCE WITH ALL APPLICABLE <br />REQUIREMENTS. <br />Based on the discussion contained in the Review process section of the Summary section of <br />this document, stipulation No. 7 was attached to this renewal. Resolution of Stipulation No. 7 <br />will initiate the time frames for the resolution of Stipulation No. 6. <br />Stipulation No. 8: <br />WATER QUALITY DATA DEMONSTRATING THE PERMANENT POND WATER <br />MEETS AGRICULTURAL/STOCKWATER STANDARDS SHALL BE SUBMITTED <br />TO THE DIVISION BY AUGUST 15, 1997. <br />The operator proposes that the sediment pond remain after reclamation to support the <br />postmining land use of rangeland and wildlife. The Division is adding Stipulation No. 7 to <br />the permit until an acceptable demonstration is made in compliance with Rule 4.05.9(1)(a). <br />Stiuulation No. 9: <br />BY AUGUST 15, 1997, THE PERMITTEE SHALL SUBMIT A DESCRIPTION OF <br />METHODS THAT WILL BE USED TO DEMONSTRATE REVEGETATION <br />SUCCESS FOR COVER, PRODUCTION, AND WOODY PLANT DENSITY AS <br />REQUIRED BY RULE 4.15.7(1) AND (2). <br />During the Division's review for permit renewal No. I (RN-O1), the Division determined that <br />descriptions of methods to be used to demonstrate revegetation success criteria have been met <br />for cover, production, and woody plant density, had not been included in the permit as <br />required by Rule 4.15.7(1) and (2). <br />Section A -Rule 2.07.6 <br />1. The permit application is accurate and complete. All requirements of the Act and <br />these rules have been complied with. (2.07.6(2)(a)) <br />2. Based on information contained in the permit application and other information <br />available to the Division, the Division finds that surface coal mining reclamation can <br />be feasibly accomplished at the Rimrock Coal Mine. (2.07.6(2)(b)) <br />3. The assessment of the probable cumulative impacts of all anticipated coal mining in <br />the general area on [he hydrologic balance, as described in 2.05.6(3), has been made <br />by the Division.
