Two <br />additional stipulations were added to field-issued minor revisions on January 13, 1993. <br />Stipulation No. 5 was added to the permit as a condition of Technical Revision No. 9. <br />Stipulations No. 6, No. 7, No. 8, and No. 9 are being added as a result of Permit Renewal <br />No. 1 (RN-O1). <br />Stipulation No. 1 required the permittee to submit a statement certified by a registered <br />professional engineer attesting that the sediment pond had been constructed as designed. The <br />original pond certification of December 23, 1992 was not accepted by the Division. NOV <br />C-93-005 was issued as a consequence. Subsequently, the February 8, 1993 pond certification <br />submittal was verified in the field by the Division. Therefore, stipulation No. 1 was complied <br />with on August 11, 1993. <br />Stipulation No. 2 stated that the operator would be responsible for repair of any subsidence <br />which might occur in existing underground workings within 250 feet of the strip pit boundary. <br />The mine plan was abandoned during the early portion of the Phase I operation. The pit <br />disturbance did not progress to within 250 feet of the identified subsidence features. <br />Therefore, no additional repair to pre-permit subsidence features needs to be conducted by the <br />operator. Stipulation No. 2 has been terminated as a result of this permit renewal. <br />Stipulation No. 3 required the operator to submit a description of the drilling program for two <br />exploration holes, including a map showing the location of the holes, pads and access roads, a <br />discussion of any affected aquifers, and a bond calculation for the reclamation of the holes, <br />pads and road disturbance. As a result of approval of Minor Revision No. 1, this stipulation <br />was satisfied on January 22, 1993. Bond was not increased because the Phase II mining <br />reclamation bond already covered disturbance in [his area. <br />Stipulation No. 4 required the operator to submit a description of the pond expansion <br />operation, including a map showing the location of the undisturbed area for material <br />placement, a description of the treatment of the topsoil and a bond calculation for reclamation <br />of the site. As a result of Minor Revision No. 2, this stipulation was satisfied on January 22, <br />1993. Bond was not increased because this site was to become part of the coal stockpile area <br />and, therefore, was already bonded for reclamation. <br />9 <br />
