<br />~~ <br />14. Specific approvals have been granted or are proposed. These approvals are <br />addressed in the following section, Section B (2.07.6(2)(m)). <br />15. The Division finds that the activities proposed by the applicant would not affect the <br />continued existence of endangered or threatened species or result in the destruction <br />or adverse modification of their critical habitats (2.07.6(2)(n)). <br />16. The Division has contacted the Office of Surface Mining, Reclamation Fees Branch. <br />As of this time, the operator, Landmark Reclamation, Inc., is current in the payment <br />of reclamation fees required by 30 CFR Chapter VII, subchapter R (2.07.6(2)(0)). <br />The mine is reclaimed and no coal will be extracted in the forthcoming permit term. <br />Section B -Rule 4 <br />I. Roads -Rule 4.03 <br />The applicant had previously provided information on drainage control for the <br />road that was used as a haul road in Sections 2.05.3(1), 2.05.3(2) and (3). The <br />operator has previously supplied the Division with a certified design for the haul <br />road and all the requirements of 4.03.1 have been complied with. As a result of <br />Technics! Revision No. 10 (TR-10), approved November 3, 1994, the Division <br />approved reclassification of the haul road to an access road. All of the <br />requirements of Rule 4.03.2 have been complied with. TR-10 also approved <br />reclamation of the southern portion of the road. Landowner approval was <br />received at that time. Due to a change in landowners in the spring of 1995, the <br />Division requested verification of the new landowners desire to retain the <br />existing portion of the road. This request can be found in Section 2.05.4 of the <br />permit application. Retention of the northern portion of the access road is <br />compatible with the approved post mining land use of rangeland. (4.03.2(1)(f)) <br />II. Support Facilities -Rule 4.04 <br />No support facilities remain on site. Pre-law concrete foundations existed on the <br />site prior to mining. These foundations were not used during the Rimrock Coal <br />Company mining operations and will not be removed. <br />Rimrock Coal Company had leased two rail loadouts from Energy Fuels Mining <br />Company, Santa Fe Loadouts Nos. 1 and 2, located in the town of Trinidad, <br />Colorado. Although the operator for Rimrock Coal Company, Landmark <br />Reclamation, Inc., reclaimed both loadouts during the summer of 1993, Energy <br />Fuels Mining Company held the reclamation bond and maintained the <br />reclamation liability for both of the loadouts.
