C-012-81 <br />Stipulation No. 16: <br />WITHIN 12 MONTHS OF PERMIT ISSUANCE, THE PERMITTEE MUST SUBMIT TO THE <br />DIVISION FOR APPROVAL, A DETAILED PLAN DEMONSTRATING HOW THE ESSENTIAL <br />HYDROLOGIC FUNCTIONS OF THE ALLUVIAL VALLEY FLOOR IN THE AREA DISTURBED BY <br />SURFACE OPERATIONS WILL BE PRESERVED OR RESTORED. THE ESSENTIAL HYDROLOGIC <br />FUNCTIONS OF THE DISTURBED ALLUVIAL VALLEY FLOOR MUST BE PRESERVED OR RESTORED <br />• TO A CONDITION SIMILAR TO THAT OF REPRESENTATIVE ADJACENT UNDISTURBED ALLUVIAL <br />VALLEY FLOORS IN THE STONEWALL VALLEY. THIS PLAN WILL BE SUBMITTED AS A <br />REVISION TO THE PERMIT. <br />To date the response to this stipulation has been "Map 15 of the New Elk <br />Permit Application indicates the potential for flood irrigation". In fact, <br />this map shows that the post-mining grade varies from 2-10-%. The local SCS <br />says flood irrigated land in the region is approximately 2-3% slope. The <br />approved PMLU tails for irrigated crop land on virtuaily all of the disturbed <br />area south of the Purgatoire, and some of the area north of the Purgatoire. <br />WFC is currently proposing grass land for these areas. Two questions arise <br />from this: <br />1) Should we require more detailed contouring plans to verify <br />flood-irrigability; <br />2) Is the planting of grass land in compliance with the approved PMLU. There <br />has been a change in seed mix proposed. <br />Stipulation No. 18: <br />WITHIN 12 MONTHS OF PERMIT ISSUANCE, THE PERMITTEE MUST SUBMIT THE RESULTS OF <br />THE ANALYSIS OF A GRAB SAMPLE FROM THE TOPSOIL STOCKPILE NEAR THE DEVELOPMENT <br />WASTE DISPOSAL PILE. IN ADDITION, THE PERMIT APPLICATION MUST BE UPDATED TO <br />INCLUDE THIS INFORMATION. <br />• A grab sample of the topsoil stockpile has been submitted along with other <br />soil samples taken to fulfill Stipulation 19.
