The Motion requests <br />approval of a settlement of this adversary proceeding betwe~an the <br />parties. CF&I brought this action against Defendant allegi:~g <br />that certain transfers made to it constitute avoidable <br />preferences under 11 U.S.C. § 547(b). The parties have agr~aed. to <br />settle the matter with Defendant making a payment of $2,100.00 <br />and being permitted to file an unsecured claim in the same amount <br />or an amended unsecured claim including such an amount. Co~~ie:s <br />of the Motion and the related settlement agreement may be <br />obtained by request from the undersigned counsel for CF&I. <br />PLEASE TAKE FURTHER NOTICE that, pursuant to Rule 523(t~) <br />of the Rules of Practice of the United States Bankruptcy Court. <br />for the District of Utah, objections to the Motion must be <br />submitted in writing, filed with the Bankruptcy Court, and ;served <br />upon the undersigned counsel on or before Friday, the 11th day of <br />June, 1993.
