This letter is written on <br />behalf of my client, BMRI, in response to issues framed in your March 3 letter. At the <br />outset, we note that BMRI has consistently monitored water quality on your client's <br />property at locations designated by your client, and has provided all of the data generated <br />from that monitoring to your client on a timely basis. Further, we note th;tt we have <br />provided you with additional information regarding the ongoing water tranagement <br />activities underway at the site and transmitted a full copy of TR-26 to you in l~:tters dated <br />February 19 and March 31, 1999. To be candid, neither the Shalom Ranch monitoring <br />data nor the data underlying TR-26 suggest any implication that water qu;ility issues <br />pertinent to the BMRI facility could, in any way, be affecting water quality in the <br />irrigation well referenced in your letter. As you will recall, in the course of your prior <br />inquiry, I advised you of BMRI's stated intention to communicate in a forthright and <br />constructive manner with you and your client regarding the mine site and to I~rovide you <br />with copies of the pertinent information developed for the agencies. Frankly, we were <br />disappointed that neither you nor your client has brought the issues framed in your <br />March 3 letter to our attention in the context of our previous communications.
