Findings of the Colorado Division of Minerals and Geology <br />for the <br />Yoast Mine <br />Fxolanation of Findings <br />Pursuant to Rule 2.07.6(2) of the Regulations of the Colorado Mint;d :Land ]iteclamation <br />Board for Coal Mining, and the approved state program, the Division of A'Iinerals and <br />Geology or the Boazd must make specific written fmdings prior to issuance of a permit, <br />permit renewal or permit revision. These findings are based on information m~ide available <br />to the Division that demonstrates that the applicant will be able to operate ins compliance <br />with the Colorado Surface Coal Mining Reclamation Act and the Re fvlations ~oromulgated <br />pursuant to the Act. <br />The findings in the following sections required by Rule 2.07.6(2) arc; listed iri accordance <br />with that Rule. The findings and specific approvals required pursuant: to Rule 2.07.6(2)(m) <br />are listed in accordance with Rule 4 and are organized under subject or discipline subtitles. <br />SECTION A <br />Findings Required by Ru1e207.6(21. <br />1. The permit application is accurate and complete. All requirements of the Act and <br />these rules have been complied with. (2.07.6(2)(a)). Seneca Coal Company is in the <br />process of obtaining all other necessary State and Federal Pern-uu. Several State and <br />Federal Permits must be obtained prior to initiating mining related activities. <br />Therefore, the following stipulation is being added to the Yoast Permit: <br />STIPULATION NO. 1 <br />PRIOR TO INTI'IATING VARIOUS MINE RELATED DISTURBANCES AT <br />THE YOAST MINE, SENECA COAL COMPANY MiJST OBTAIN THE <br />FOLLOWING PERMITS AND SUBMIT COPIES TO THE DMSION: <br />1. NPDES PERMIT- PERMIT REQUIRED PRIOR TO C'ONSTRIJCTION OF <br />SEDIMENT PONDS AT THE YOAST MINE. <br />2. STORM WATER DISCHARGE PERMIT- PERMIT REQUIRED PRIOR <br />TO CONSTRUCTION OF THE HAUL ROAD AND ALL iviINING ACTIVITY. <br />3. WATER RIGHTS AND AUGMENTATION AI'PROVAL- <br />DOCUMENTATION OF APPROVAL OF WATER RIG]3TS AND <br />AUGMENTATION PLAN FROM DISTRICT COiJRT PRIOR TO <br />Yoaa~ Mint 16 July 6, 1995 <br />
