The diversion ditch is <br />required because the pond drains a watershed of o~•er 300 acres which is a <br />design flaw that we brought to rCLRD's attention. Because of the limited <br />boundary that was agreed, the sediment pond and the diversion ditch will be <br />outside the boundary. Harrisor. 4:estern will be required to perform majcr work <br />outside their boundary, but the more serious problem is that once the cork is <br />completed, Harrison Western will no longer be responsible for maintenance of <br />the pond or ditch. <br />The Board approved the agreement despite our objections. They did not address <br />the problem of conversion of the previously eri.sting diversion ditch into a <br />road, and problem of lack of long term maintenance of the pond and future <br />ditch was settled by their hope that these structures would not be needed for <br />long. <br />As the land owner, The Corley Company is hereby requesting that the Office of <br />Surface Mining inspect the mine site and review the records. it is clear that <br />MLRD has no[ required much in the past from }i.;r r'scn Western, and to let <br />Harrison Western arbitrarily select only a small portion of the ~:'est Pit for <br />their boundary seems to be a compounding u~ the many past errors. <br />Sincerely, <br />i ! ~ F <br />W.D.
