Following that, Dr. Corley of the Corley <br />Company stopped at this office to discuss the content of the letter with several of our staff <br />members. He is concerned about a number of things that have resulted from a Colorado Mined <br />Land Reclamation Board hearing held in your office on April 22, 1992. Following the review <br />of the letter end discussion with Dr. Corley, Gary Fritz of our office reviewed the matter with <br />a number of your staff members via phone. <br />At this time, we have concluded that the information contained in the letter is not sufficient to <br />form a reason to believe that a person is in violation of the Act, the approved State program, <br />or permit. Therefore, in accordance with OSM Directive INE-35, we ere transmitting Dr. <br />Coney's letter via this correspondence. <br />Based upon our discussions with Dr. Corley end your staff, we have some questions for which <br />we would appreciate receiving information. <br />In the recent Board meeting held in your office, of which Dr. Corely was in attendance, a <br />Compliance Agreement was drawn up between the Board end Harrison Western Corporation, <br />a copy of which was attached to his letter for this office's information. In that agreement, a <br />chronology was listed of the events leading up to the present status of the mining area for which <br />the bond is being held for reclamation end a compliance schedule for additional work to be <br />performed. <br />There ere a number of items in the compliance agreement to which Corley Company, as the <br />landowner of the area in question, has taken exception. The Albuquerque Field Office (AFO) <br />has reviewed the letter from Dr. Corley and the compliance agreement with the Harrison <br />Western Corporation. It is not clear in the letter or in our permit documents of the mine es <br />to what was bonded under the Harrison Western Corporation bond posted for the GEC <br />Minerals. Please provide a description of the area originally bonded. <br />
