<br />Mr. Rathbun <br />Page 2 <br />The Division has not received the responses as of this date. As 2 <br />mentioned to you yesterday, Terror Creek has recently gone through <br />some personnel changes with their regulatory contact. Kelly <br />Fritzler is now the State's contact, and is not up-to-date on our <br />rules and regulations, nor is he sure of what his predecessor had <br />done. Terror Creek has recently hired Jim Stover to assist them in <br />regulatory compliance. I talked with Jim Stover at the beginning <br />of this week and he stated that he should have the responses to the <br />Division within one to two weeks. I am sure we will see the <br />responses soon. <br />During the inspection yesterday, you also mentioned the wording in <br />the cancellation notice of the insurance certificate needed to be <br />revised. During January of this year, I worked with the insurance <br />company to get the phrase "endeavor to", omitted from the document. <br />I was successful in my attempt and the Division received the <br />revised document on January 16, 1992. The insurance policy expired <br />on July 21, 1992, and the renewed policy includes this previously <br />omitted phrase. I have notified Terror Creek that they must get <br />this policy corrected in order to comply with Rule 2.03.9(3) of the <br />Colorado Rules and Regulations. I plan to follow-up on this, so <br />that we have the correct policy within a reasonable amount of time. <br />I believe this addresses the concerns you had regarding the Terror <br />Creek Loadout. If you require more information on these issues <br />please do not hesitate to contact myself or David Berry.
