Box 1821 <br />Colorado Springs, CO 80901 <br />RE: GEC West Pit Drainage Work <br />Dear Dr. Corley: <br />The Division received your letter dated January 25, 1994. In that <br />letter, you indicated that you no longer wished to proceed with the <br />previously discussed plans for removing the West Pit sediment pond <br />and routing surface runoff from the pit and the upland watershed <br />directly into the Magpie Creek diversion. Consequently, the <br />Division will instruct Kessler Reclamation Co. to proceed with the <br />drainage plans contained in the original bid documents for the <br />G.E.C. Orphan Pit project, as modified to fit the available funds <br />for the work. <br />A final change order modifying the construction specifications for <br />the proposed ditch will be issued following consultation with Phil <br />Kessler. The final specifications will include the maximum channel <br />capacity and armoring which Kessler Reclamation Co. can provide at <br />a cost of $18,500. This plan will be carried out in accordance <br />with the April 19, 1993 "Agreement Concerning Diversion of Water <br />into Magpie Creek" entered between The Corley Company and the <br />Division. <br />Please be aware that, in accord with paragraph 10 of the agreement, <br />the Division is not to spend funds other than the $18,500 from <br />Harrison Western Corporation to perform the drainage work. Nor is <br />the Division to perform any further work in regard to the drainage <br />improvement after those funds are exhausted. Following <br />construction of the proposed diversion and expenditure of the <br />$18,500, the Division will no longer have funds available for <br />further work in the West Pit. <br />The Division will meet with Mr. Kessler as soon as possible to <br />discuss the final construction specifications for the diversion. <br />A copy of those specifications will be forwarded to you when they <br />are available. Weather permitting, the West Pit work will be <br />completed this winter. Otherwise, the work should be concluded <br />this spring in conjunction with seeding of the reclamation work <br />done by Kessler this past autumn. <br />
