-2- The total area of the permit revision area to be included within this permit, including the angle of draw, is 542.2 acres, and includes the following lands: W 1/2 NE 1/4; SE 1/4 NE 1/4; S 1/2 S 1/2 NE 1/4 NE 1/4; W 1/2 SE 1/4; NW 1/4 SE 1/4 SE 1/4; NE 1/4 SE 1/4 Section 18, T13S, R91W of the 6th P.M. N 1/2 NW 1/4 NE 1/4 Section 19, T13S, R91W of the 6th P.M. SW 1/4; S 1/2 NW 1/4; S 1/2 S 1/2 NW 1/4 NW 1/4; S 1/2 S 1/2 NE 1/4 NW 1/4 Section 17, T13S, R91W of the 6th P. hi. and including that portion of Section 17, T13S, R91W of the 6th P.M. described as follows: Beginning at the S 1/4 corner of Section l7, thence on an assumed bearing of north along the subdivision line to the northeast corner of the SE 1/4 NW 1/4 Section 17, thence on a bearing of each along the subdivision line a distance of 25 feet, thence on a bearing of south, parallel with the subdivision line, to the south boundary of Section 17, thence on a bearing of west a distance of 25 feet to the point of beginning. CWI's application for a permit revision included information from the adjacent existing Orchard Valley Permit Area C-038-81 (incorporated by reference) as well as the proposed Permit Revision Area. For this reason, the Division has reviewed both the approved existing permit C-038-81 application (henceforth referred to as "1981 application") and the proposed permit revision application for compliance with the Act and Regulations of the Colorado Mined Land Reclamation Board for Coal Mining. This "Proposed Decision" and "Findings of Compliance" apply to both the existing Permit Area of Permit C-038-81 and the proposed Permit Area of the Permit Revision which will now be incorporated as one permit area under one permit. The proposed new permit area will include a total of approximately 2,283.5 acres (1,741.3 acres from the 1981 permit, plus 542.2 acres from the permit revision area). The legal description of the proposed permit area can be found in the revised permit application. This "Findings of Compliance" document will supersede the findings proposed on August 20, 1981 for the existing Orchard Ualley Permit No. C-038-81. This document also takes into consideration any stipulations imposed on Permit C-038-81 by reinforcing those stipulations that still apply.
