The shrubs will be planted, after the affected <br /> acreage has been seeded, in clusters approximately 0.5 to 2 acres in <br /> size and will cover 30 acres of the total 110 affected acres. <br /> Newly planted areas will be mulched with hay or straw. Crimping or <br /> tracking will be used to stabilize the hay or straw mulch. Straw mulch <br /> or an equivalent cover of hydromulch, wood chips, jute netting, <br /> excelsior mat, etc. will be applied. After seeding, revegetated areas <br /> are protected from livestock grazing until areas are judged capable of <br /> withstanding grazing pressure. Protection of revegetated areas is <br /> accomplished by excluding livestock by using fences, or discontinuing <br /> grazing on adjacent areas by other means. <br /> XII. Post-mining Land Use <br /> 1. The Division is proposing to approve a post-mining land use of <br /> rangeland and wildlife habitat. The land use meets the criteria of <br /> Rule 4.16.3. <br /> XIII. Protection of Fish, Wildlife and Related Environmental Values <br /> 1. Information regarding compliance with Rule 4.18 is located in <br /> Section 2.05.4 of the permit document. <br /> 2. wildlife habitat is a planned post-mining land use. The applicant <br /> has selected appropriate plant species and distributions to benefit <br /> wildlife. <br /> XIV. Protection of Underground Mining <br /> 1. There are no current or proposed surface mining operations within <br /> or next to the West Elk Mine. <br /> Xv. Subsidence Control <br /> 1. The applicant has proposed a subsidence control plan in accordance <br /> with Rule 2.05.6(6) and has committed to adopt all measures in <br /> order to reduce the likelihood of subsidence, prevent material <br /> damage, or mitigate the effects. The Division proposes to approve <br /> the plan (4.20.1 (2) and 4.20.3 (1) ) . <br /> A subsidence monitoring plan to monitor mining in B seam for the <br /> five-year permit area is included in Exhibit 60 of the permit <br /> application. The monitoring plan will provide additional data <br /> which, when used with the F seam data, can be utilized for future <br /> mine planning considerations. MCC has proposed two additional <br /> north-south monument lines and two additional east-west monument <br /> lines to monitor B seam only mining subsidence, which will evaluate <br /> mining in the Jumbo Mountain Tract. <br /> The effect of mining-induced subsidence or renewable resources, <br /> structures, and geologically unstable areas in the five-year permit <br /> term is discussed in a report entitled, "Subsidence Evaluation for <br /> the West E1k. Mine" and can be found in Exhibit 55. A limited <br /> mining buffer zone has been designed to protect the Dry Fork and is <br /> included as Appendix B to Exhibit 55 and is shown on Map 50 . <br /> 2. The applicant has proposed a subsidence monitoring program, in <br /> accordance with Rule 2.05 .6 (6) (c) , designed to determine the <br /> commencement and magnitude of subsidence movements. Maps included <br /> in Exhibit 60 depict the location of monuments to be installed and <br /> structures to be monitored within the permit and adjacent area. <br /> The results of the monitoring program will be submitted to the <br /> Division semiannually. The monitoring program is designed to <br /> extend for a time, beyond cessation of mining in any area, <br /> 45 <br />
