<br />TELEPHONE CONVERSATION RECORD <br />• <br />Date: May 16, 2000 <br />Call From: Sandy Vana-Miller, Wildlife Biologist, PSD, OSM, Denver, CO, 303-844-1400 <br />Call To: Terry Ireland, USFWS -Western Colorado Office, Grand Junction, CO, 970-243- <br />2778 x 16 <br />Subject: Compliance with the Endangered Species Act (ESA) for National King Coal <br />LLC.'s King Coal Mine, Mining Plan Modification <br />I called Terry Ireland, Biologist, to discuss the proposed mining plan modification for the <br />addition of 160 acres of new Federal coal to lease COC-60941. Located in LaPlata County, <br />Colorado, [he proposed operation would be a typical room-and-pillar underground mine. I <br />explained that there would be no change in production rate and no additional surface disturbance <br />as a result of [he proposed modification. <br />Based on this information, Terry concurred with my determination that the proposed King Coal <br />Mine -Mining Plan Modification would have no effect on threatened or endangered species or <br />their critical habitat. [n accordance with the 1996 Biological Opinion and Conference Report <br />from the USFWS to OSM on Surface Coal Mining and Reclamation Operations under SMCRA <br />of 1977, Terry stated that no further discussion (including species-specific protective measures) <br />was necessary at this time. However, OSM and the Regularity Authority should contact the <br />USFWS if there are changes to the operation that would change the annual water depletion or <br />potentially affect listed or proposed species or their critical habitat. <br /> <br />(Signature) <br />Sic o~ <br />(Date) <br />• <br />
