-2~ <br />On December 3, 1992, we wrote to Mr. Ossola documenting the status of our responses to his <br />concern with the mine exhaust (copy of our letter enclosed). We informed Mr. Ossola that concerns <br />regarding air quality should be directed to APCD. <br />On December 21, 1992, we received a letter from Mr. Jim Tatum regarding his concerns with the <br />mine exhaust fan (copy enclosed). On January 19, 1993, we responded to Mr. Tatum, advising him <br />to direct his concerns regarding explosions of mine exhaust at the surface to MSHA (copy enclosed). <br />On Febrnary 3, 1993, we contacted Mr. Lewis McBride with APCD to discuss the vegetation <br />downdraft of the exhaust fan that was apparently being impacted by the exhaust. Mr. McBride <br />indicated he would investigate, but stated that Basin Resources had received an exemption from the <br />air quality regulations from APCD because the exhaust was considered to consist of only methane. <br />On February 11, 1993, we wrote a letter to Mr. McBride stating that we believed the resolution of <br />the issue of potential damage to vegetation from the exhaust fan fell within the jurisdiction of the <br />APCD (copy enclosed). <br />On February 12, 1993, we received two letters from Mr. Tatum regarding the exhaust (enclosed). <br />On Febniary 25, 1993, Mr. Tatum called us to discuss the status of the investigation into his <br />concerns with the exhaust fan. We indicated to Mr. Tatum that we had conducted an inspection of <br />the site and that some of the trees had shown signs of recovery. <br />On June 4, 1993, we received another letter from Mr. Tatum regarding the dead vegetation caused <br />by the mine fan exhaust (enclosed). On July 7, 1993, we responded with a letter documenting <br />several issues that were being investigated at that time, and that on February 3, 1993, Mr. McBride <br />indicated to us that he would be investigating the specific complaint regarding the mine's exhaust <br />impacting the vegetation near the fan (copy of the letter enclosed). <br />Please contact Mr. Tatum directly at the address provided and inform him of the APCD <br />requirements for coal mine exhaust fans. Further, if any other investigations have occurred, please <br />inform him of such and the results, if any. In order that our office is adequately informed, please <br />copy the Division on any correspondence to Mr. Tatum.
