Box 1430 <br />Palisade, Colorado 81526 <br />D-~'-s-on o/ MfnaRla R ~ <br />OrantiJunpgn <br />Re: Access Road Reclamation <br />Driiiing Enploratiou Plan <br />Coal Lease COC-029889 <br />BLM Access Road Right-of-Way (R/W) <br />Dear Mr Reschke: <br />This letter is a result of the joint inspection with Dave Trappett and Bruce <br />°owler of my staff, and yourself on September 3, 1997. The inspection <br />included three access roads to drill holes identified as PCC-O1 through PCC-10 <br />in your 1984 and 1985 drilling exploration plan. <br />The first access road inspected, accessed drill holes PCC-06 through PCC-10. <br />The inspection and additional review of records revealed that the road in <br />question was utilized for fire control by BLM after you had completed <br />reclamation. In addition, BLM management of this access has changed since we <br />first required you to reclaim the road. This access has been identified for <br />use in the Grand Mesa Slopes recreation plan and therefore we do not want any <br />additional reclamation completed on this access. <br />The second access road inspected, accessed drill holes PCC-04 and PCC-O5. <br />According to our letter of October 25, 1985 (enclosed), the reclamation <br />requirements for this road was to install waterbars and to seed it. This work <br />has been completed. Vegetation has been established and additional <br />reclamation would be counter productive as it would cause additional <br />unnecessary erosion. BLM does not want any additional disturbance to occur on <br />this reclaimed area. <br />} The third access road inspected, accessed drill holes PCC-O1 through PCC-03. <br />~rThis road has been reclaimed to the requirements of the approved plan. <br />Specifically, BLM requested that the portion of the access road south and west <br />~~fy~f of the south portals be left in place and not recontoured from the south <br />~q~i portals to near the top of the dugway in Lot 5, Section 11, T. 11 S., R.98 W. <br />P n ,/ This was requested to facilitate livestock management. Therefore, the BLM <br />~'~U does not want any additional reclamation completed on this access road. <br />In addition, a portion of the access road to drill holes PCC-06 through PCC-10 <br />traversed a portion of BLM surface that was off of your lease and Colorado <br />State permit area. BLM R/W COC-40248, which permitted your use of this <br />portion of the road, expired on June 6, 1986. This letter serves as a release <br />of your liability to the BLM for reclamation on the above identified access <br />roads (on and off lease) as well as the drill holes. If in the future, you <br />::ave the need to use any off-lease road on BLM surface, beyond that use <br />
