III IIIIIIIIIIIII III ~
STATE OF COLORADO
DIVISION OF MINERALS AND GEOLOGY
Department of Natural Resources
1313 Sherman St., Room 215
Denver, CO 80203
Phone: 1303)866-3567
FA%: 13031832~8I06
January 4, 1993
Dr. W.D. Corley
The Corley Company
P.O. Box 1821
Colorado Springs, Colorado 80901
RE: Citizen's Petition for Declaratory Order, September 8, 1992,
G.E.C. Minerals, C-81-037
Dear Dr. Carley:
OF' ~~(O
tib
Ne'
V~ ~r<
~ r8]6 ~
Roy Romer
Governor
Michael B. Long
Division Director
The Division received your request to retain the access road for Drill Hole NC-7 on
December 16, 1992. The Division's regulations allow for the retention of access roads if
they meet all applicable performance standards and the landowner requests it (Rule
4.03.2(1)(fl). The road itself is well vegetated and the southern end of the road cut has
well established vegetation and mature trees. The northern portion of the road cut should
be reseeded to promote additional vegetation. There is no significant erosion on the road
cut or the road. and runoff does not appear to be resulting in an increased situation
pollution problem. The road expands the stream valley bottom in this area incrementally
but does not result in a significant change in the original topography of the area. Lastly,
the landowner has requested that the road be retained to support the post mining land use.
Consequently, the Division will drop their request to Sheridan Enterprises to reclaim the
drill hole access road on the condition that the northern portion of the road cut be
broadcast seeded at a rate of 80 PLS/acre of a suitable reclamation seed mix.
I hope this accommodates your request.
Sincerely,
Catherine W.
