.~
June or July because the same occurrence
informed him we were not here in June or
had was a guard watching the Mill.
happened then. I
July and all we
Mr. Gole also informed me that he was in his back yard at
10:00pm on Oct. 24th and observed the creek as being dry
at that paint, he woke up at 3:OOam went outside to
attend to some personal business, at which time he
observed Cash Creek about to overflow its banks.
Given the volume of water that was being discharged and
the relative short distance I would estimate the valves to
have been open no earlier that 9:30pm the evening o£
Oct.24th, and no later than 2:30am the morning of
Oct.25th.
After observing the water flow I instructed Jimmy Tatman
to walk the pipeline containing water coming from the Gash
Mine to the tailing pond. He reported back to me that a
valve had suffered some freeze damage and I assumed that
to be the source of the problem. I immediately called
Mark Steen and requested he discontinued pumping of the
Gash Mine, I then called Bob Mason and left a message on
his answering machine to contact me right away. About an
hour later I ran into Bob Mason in front of the
General Store and informed him that we had a problem that
we had traced down to a broken valve and Mark Steen was on
his way to shut the water off. At approximately 11:OOam
Mark Steen arrived at the Mill. He then pointed out to me
that. the valve from the tailing pond was open and that he
had only cracked it open. I then informed him that as soon
as he left the property I had Jimmy turn it off. He then
came to the conclusion that instead of Jimmy closing the
valve he opened it.
In numerous conversations I had with Mr. Steen regarding
this matter he has insisted that Slmmy opened the valve.
I infor~oed him that if Mark was not the one that opened
the valve then we have ghosts up here and Casper did it.
Under Mr. Steen's theory that Jimmy inadvertently opened
the valve at noon on Oct.24th, then 480,000 gallons of
water would have showed up in Mr. Coles back yard before
10: OOpm.
One of the exhibits found in the permit are the results
from the portal was Copper mg/1, 0.1700, Zinc
mg/1,37.4000,Lead mg/1,0.2400, Mercury mg/l,<0.0001, PH
solids-dissolved mg/1,1,590, suspended mg/l, <10. I am not
qualified to comment on the damage that occurred but I bet
it didn't help matters any.
#2. As per your suggestion I contacted Mr. Allen Berryman,
