During the last several months of 1994 the State of <br />Colorado, through its contractor and agent, Colorado west <br />Leasing Company (Colorado West) at the request of the <br />Division of Minerals and Geology came upon Corley'a lands <br />and engaged in certain ~~reclamation" activities. in the <br />course of those activities, Colorado Weat did substantial <br />damage to an access road on the property of Claimant, <br />damaged a gate, left a large ground soaked spot of oil <br />pollution, damaged a ditch rendering said ditch non- <br />functional (causing water flows into a settlement pond where <br />such water should not flow), inadequetly sloped certain <br />lands which were the subject of reclamation and otherwise <br />caused damage to Claimant. <br />c. Claimant is unaware of any public employee having <br />directly disturbed the lands but alleges that the land was <br />disturbed by the State of Colorado's contractor, Colorado <br />West, acting at the direction of the State. <br />
