Coal Methane Dranm2e Project - PaneG Y6-24 Wert E!k Mime <br />• PaPt 2-70 <br />helicopter access would not be operationally or economically feasible and would offer limited benefits <br />relative to incremental reduction ofproject-related environmental impacts. <br />2.4 CONDITIONS OF APPROVAL <br />Conditions of approval applicable to any and all alternatives are designed to prevent, control, <br />minimize, and/or mitigate potential project-related unpacts and to effect full compliance with ail <br />applicable regulatory requirements and guidelines. Certain conditions of approval are specific to an <br />activity, affected resource(s), or where exceptions to lease stipulations are needed to allow the surface <br />activities necessary to support coal mining operations. The following conditions of approval <br />(standard mitigation measures) would be applied to all action alternatives (Alternatives 2 through 5) <br />unless noted as being specific to an activity, resource, or exception to a lease stipulation. <br />2.4.1 Road and Drill Pad Construction <br />1) Road work will be performed only upon authorization of the District Ranger and comply <br />with the terms of MCC's Road Use Permit. Roads will be designed and constructed to <br />provide maximum stability and protect the surface resource. Best Management Practices will <br />be used in designing the roads and during construction. All roads will be upgraded or <br />constructed to USFS specified standazds for either temporary or classified roads, as <br />appropriate and approved by the USFS, with a design speed of 15 mph. <br />2) MCC shall notify the District Ranger at least 24 hours in advance of operations commencing <br />on National Forest Lands unless previously approved <br />3) The responsible USFS official, prior to ground disturbance, shall review and either approve <br />or deny approval to construct any drill pad location and the final alignment for new roads. <br />Staging area locations must also be approved before use. When disturbing ground in areas <br />where exceptions have been approved for lease stipulations, MCC will provide notification at <br />least 10 days in advance. Ground review by the USFS is required prior to initiation to <br />determine if additional mitigation measures are needed in these exception areas. <br />4) Surface disturbance will be minimized to the extent reasonably feasible in order to limit <br />potential impacts. Soil that is removed from all new disturbance areas will be windrowed or <br />stockpiled for use in reclamation. Topsoil will be segregated from subso$. No soil generated <br />from excavation, slide removal or other operations shall be deposited within the WIZ of any <br />drainage with flowing water. <br />5) Before removing and trees, the trees will be designated and the removal approved by the <br />USFS prior to removal. MCC will be chazged the value of the trees removed. Controlled <br />felling techniques will be used. Any slash generated from tree removal operations shall be <br />lopped and scattered to a maximum depth of 2 feet. <br />6) MCC shall shut-down operations immediately in areas in which any antiquities or items of <br />historic or scientific interest aze discovered. MCC shall bring the discovery to the attention <br />of the District Ranger immediately. MCC will comply with the National Historic <br />Preservation Act to protect any cultural resources that may be present. <br />All disturbed and inactive areas (cut/fill slopes) and soil stockpiles shall be seeded with a <br />USFS approved temporary seed mixture within 7 days following disturbance to prevent <br />noxious weed infestation and minimize erosion <br />S) All construction, reconstruction, and improvements will be stabilized by installation of <br />drainage structures, where determined appropriate by the responsible USFS official, <br />EnvrmnmenlalA.crerrment <br />~ilim,w <br />
