Banal, <br />Dinsion Drtmor <br />Thank you or your letter recently submitted to our Division regarding your <br />concerns w th Cast7e Concrete Company's Snyder Ouarry, Your letter requested <br />that the C lorado Mined Land Reclamation Board not allow Castle Concrete to <br />strip mine Phase 3 any sooner than the 1974 court decision originally allowed. <br />Section 34 32-112 of the Colorado Mined Land Reclamation Act (34-32-101 et <br />sea., 1973 as amended) requests an applicant to provide in its application <br />"Tfie ti met ble estimating the periods of time which will be required for the <br />various st ges of the mining". The Statute goes on to say that "the operator <br />shall not ereauired to meet the timetable, nor shall the timetable be <br />subject to independent review by the Board." As such, the Board by law has <br />little con rol over an applicant's mining timeframes, includinD when mining of <br />a phase ma commence. <br />Decisions ~egardinq operators made in civil courts are matters not within our <br />Board's ,7u tsdiction. Any conditions, restrictions, or schedules placed upon <br />Castle Con~rete Company by a court are for that court to enforce. Thus, <br />concerns a~out certain court orders related to Castle Concrete Company should <br />be directe to those courts. <br />Concerns a out local land use issues, impacts to your Duality of life, and <br />impacts to~your local tourism should be directed to your Board of County <br />Commission rs. <br />As a final note, the Colorado Mined Land Reclamation Board approved Castle <br />Concrete C mpany's Phase III Amendment on December 13, -1.99 Ig9q. <br />I hope thi has helped make jurisdictional matters clearer for you.
