III IIIIIIIIIIIII III
The Corley Company
Phone 632-6050 P.O. Box 1821
COLORADO SPRINGS COLORADO 80901
RFCF~v~o
Jan. 25, 1994
JAN 26 1994
Mr, Larry P, Routten
Division of Minerals & Geology =1..~~,~ • , ~;,,~~E ~~,~ 6lacl'IC(!v
1313 Sherman St.
Denver CO 80203
Dear Mr. Routten:
Our understanding of the Dec. 21, 1993, meeting was that you were going
to prepare the amended agreement and the proposed letter to the board
for our review. Obviously, there was no meeting of the minds regarding
the letter.
Specifically about the letter, you only state that "the previous
modelling was in error". There is no indication of the magnitude of
error which is approximately 600%. You state that the undersized
culvert resulted in "some. problems". We think that any reader of
the letter would minimize the impact of the "problems".
You do mention that the DMG-Harrison-Western-Corley agreement states
that the Division determined that the actual cost will not exceed
$18,500, but you do not mention that there was no construction plan on
which to base that cost estimate. Further, the low bid for the work was
not $29,000, but $33,000.
Since you want us to communicate any corrections to the Board, we do not
believe that you have completed your part of the agreement. We no
longer wish to go ahead with our suggested compromise. [de understand
now that any future agreement must be in writing. Do you have any
suggestions?
With regard to the DMG letter to the Vento Trust, there is a property
description for the Duck Pond of the "EZti Sec 24". That same
description was used for the Vento Trust property. The E41~ of a section
does not exist. The Duck Pond is in the SEI~NEZ and the NEtiSE14 Sec. 24.
The Vento Trust does not own any land in Sec. 24; they own the SW1 Sec.
19. Mr. Robinson was confused about the location.
S'i`nlcer(~e]ly, ~
W ~~-
W.D. Corley,
President
