One of the concerns in that letter involved a lack of
demonstrations (consistent with the type of demonstration a rrently required)
for the alternative sediment control measures (SAE'S) in place at the New Elk
Mine. In response to the AFO and in order to resolve this issue, the Division
is requesting Wyoming Fuel Company to submit a technical revision providing a
demonstration consistent with the requirements of Rule 4.05,2(3) for the
measures currently employed at the New Elk Mine, At the same time, it would
also be expeditious to undertake the same revision to the Golden Eagle Mine
permit. The Division is requesting that Wyoming Fuel Company submit the
revisions within thirty days of the receipt of this letter,
I you have any questions or require any assistance in the development of the
demonstrations please contact me or Berhan Kefellew.
Sincerely,
~~5~Y1„~~~/~~
Michael S.
