<br />On December 21, 1958, Delta Sand and Gravel Co. <br />purchased 40 acres of ground consisting of the NW 1/4 <br />NW 1/4 Sec 18 T 15 S R 95 W of the sixty P.M. This <br />property is situated on both sides of the Gunnison <br />River and the portion on the north side of the river <br />was permitted, mined and released by the M.L.R.-13 <br />under permit #M 77 021. The material from this site <br />was hauled to our existing plant site and processed. <br />Previous to the passage of The Mined Land Reclamation <br />of 1973 the south side of the river had been mined and <br />reclaimed and is the present site of the home, pastures <br />and barns of the Starner residence. Copy of the 1958 <br />purchase agreement on this property is attached. <br />On August 27, 1975, Delta Sand and Gravel Co. purchased 23.9 <br />acres of ground that had been partially mined by Coors Brewing <br />Company in the 1960's. This property adjoins our present plant <br />site and is currently in the final stages of mining and is under <br />our present germit for Pit #1, M-77-020. Mining and reclamation of <br />this pit will be virtually completed in 1994. Material from this <br />pit has been hauled by truck to our existing facility established <br />in 1954. At the present time, we are also trucking material for <br />processing from our Pit #4, approximately 1.5 miles from our <br />existing facility. The permit # M-88-079 covers Pit #4 area. <br />We feel that with the above information and the attached <br />copies of various documents will clearly show that this processing <br />area should not be included in permitting regulations.
